In consideration of the moneys received and the mutual promises herein, the member/owner of the subject property does hereby lease and rent to Tenant that certain property at 259 Luchase Road, Linden Virginia 22642 under the following terms and conditions.
1. ADVANCE RENT PAYMENT: One-half of the rental rate shown above and the signed lease agreement must be returned to Beau Ridge Cabin Rentals LLC within ___ days of reservation date. This agreement shall not be binding unless and until Beau Ridge Cabin Rentals LLC has received signed lease with ADVANCE RENT PAYMENT and all checks have cleared the bank.
2. BALANCE DUE including a $50.00 refundable security deposit must be received ____days prior to arrival. Acceptable forms of payment include personal check, Visa, Mastercard, Discovery. A $40.00 handling fee will be charged for all returned checks. All reservations must be paid for in full prior to check-in and possession of premises.
3. CANCELLATIONS must be made in writing by letter or e-mail and received prior to check-in. Refunds are available if the property is re-rented. The Tenant is responsible for verifying the receipt of the cancellation letter or e-mail. If the property is not re-rented any and all prepaid payment will be forfeited.
4. SECURITY DEPOSIT is required to secure the faithful performance of Tenant's promises and duties contained herein. Tenant covenants and promises to surrender the property in as good and same condition as of commencement of the rental period. Tenant agrees to reimburse Beau Ridge Cabin Rentals LLC any amount above the security deposit for all repairs due to damages, replacements or cleaning including attorney's fees.
5. DAMAGES to the property during occupancy are the Tenant's responsibility and must be reported to Barbara DeRaad, a member/owner of Beau Ridge Cabin Rentals LLC, immediately and paid for prior to departure. If the cost of the damage is undeterminable by the time of departure, the Tenant shall remain responsible for such costs and agrees to pay promptly when notified of assessed amount.
6. INJURY: Barbara DeRaad, Alan DeRaad and their heirs shall not be held responsible for injuries to Tenant or guests of Tenant on or off said property during duration of lease.
7. LINENS, bed sheets, pillow cases, bath towels, face towels, wash cloths are available for $12.00 per person per stay.
8. PAPER PRODUCTS, BATH SOAP must be provided by Tenant.
9. SHOOTING FIREARMS: Target practice or discharging a firearm is unlawful in Skyland Estates and Blue Mountain Subdivisions. Hunting is permitted during hunting season only in G. THOMPSON WILDLIFE AREA.
10. CHECK OUT: Tenant will remove all food and waste using plastic bags provided. Turn thermostate to 55 in winter, empty dishwasher, extinguish any fire in fireplace, lock windows and doors and leave key inside lock box.
11. HOUSEKEEPING SERVICES are not available. The cabin must be left in the same clean condition prior to occupancy otherwise the security deposit or a portion will not be refunded.
12. DEER LAKE AND RECREATION AREA: Tenant may use the lake, tennis courts and all recreation area with a note of permission. This is located in Blue Mountain Subdivision. A map and note will be provided.
13. OUTDOOR BURNING : We must guard against forest fires so out door burning is not allowed except in a contained fire pit.
14. LAWS AND REGULATIONS: Tenant must comply with all laws, regulations, ordinances and requirements of all municipal, state and federal authorities that are effective during the term of the lease agreement.
15. SMOKE FREE: No smoking inside cabin.
16. NO PETS:
LIMITATIONS OF LIABILILTY. The parties to this contract stipulate and acknowledge that Beau Ridge Cabin Rentals LLC is organized and operated under the laws of the State of Virginia as a limited liability company and as such the member/owners and managers of Beau Ridge Cabin Rentals LLC have limited liability as a matter of law for the activities, obligations, debts, and liabilities of Beau Ridge Cabin Rentals LLC. The parties to this contract specifically agree and stipulate that, pursuant to the laws of Virginia with regard to limited liability companies, the members/owners and managers of Beau Ridge Rentals LLC have no personal liability and will assume no personal liability for this contract, either in whole or in part.
IN WITNESS WHEREOF, this agreement executed by each party hereto. Tenant acknowledges and accepts all TERMS AND CONDITIONS as set forth on both sides of this agreement.
